A liability waiver is what I call a “feel good document.” Please be aware that in many states a liability waiver isn’t worth the paper it is written on. I would strongly urge you contact an attorney and get his/her input based on the laws in effect where you live. Years back, when I was involved in the Harley Owner’s Group (HOG), we had participants in any chapter sponsored event sign a liability waiver even though we knew it would not stand up in court given certain circumstances. And any attorney (I won’t use the term “good”) will try to prove you did not take the proper precautions to avoid a condition that contributed to an “injury.” An honest person will accept responsibility if they incur an injury on your property that is a result of their own stupidity, a sleazy person will run to the closest ambulance chasing lawyer. Two key words: litigious society!
