Louisiana Man "Sue's" over Defective New RV

Good for him. He wants a Jury trial!

I hope he wins and sets the RV Industry on it's head over their lack of quality and timely warranty repair!

I only hope he gets the remedy he deserves, which will be determined by a jury of his peers or the judgement of the court.

Assuming the plaintiff has a valid claim, this will likely end in a quiet out-of-court settlement that includes a gag clause. It will benefit the plaintiff, but do little to change the industry. The threat of a jury trial is merely the big stick to motivate the defendants to settle.

If the RV Industry was facing a large class action lawsuit , I could see where the outcome could cause major changes in the RV industry. This suit will only affect the individual plantiff and no matter what the outcome will have little or no affect on the defendant or the RV Industry as a whole.
If this case has major implications for the RV Industry , it will be dragged out in appeals court for years in order to lessen the financial impact.
The only one who " WINS" in these proceedings are the attorneys.

There is now a second suit against Jayco, same court district as well as same attorney representing another client.

Jayco is now owned by Thor who is in turn owned by Berkshire Hathaway . BH has deep pockets and a large legal team.
Good attorneys often can overcome the law and win a case even if the plantiff is in the right. The plantiff in these cases may well get a ruling in their favor but I doubt BH will admit fault or allow the ruling to set a presidence for future litigation.
